Timing is Everything

It was recently revealed that Governor Hochul has included in her proposed state budget provisions that seek to roll-back aspects of the bail reform measures that went into effect in 2021.

If Governor Hochul is successful, an individual who is accused of a crime will be much more likely to face incarceration pending the outcome of their criminal matter. Despite the age-old adage that a person should be regarded as innocent until proven guilty, the bail system in New York allows the courts to detain and incarcerate individuals until their matter is resolved. This can sometimes even result in individuals staying in custody for longer than the maximum jail sentence permitted under statute, without the individual ever being found guilty or having their day in court.
